In this video, Dr. K K Aggarwal, Padma Shri Awardee, Editor-in-chief IJCP Publications, will talk whether doctors can be charged under IPC Section 308. Section 308 is an attempt to commit culpable homicide. It states that whoever does any act with such intention and under such circumstances that if it caused death, he would be guilty of culpable homicide and would be punished with imprisonment of 3 years or with fine or both. Dr. Aggarwal explains whether it has caused damage to the patient due to the doctor’s or administrator’s negligence then he can be charged under IPC Section 308. Also, each doctor should keep all the necessary facilities and equipment such as oxygen machine and cylinder, ambubag, resuscitation first aid kit etc.
